This Privacy Policy explains how Fulcrum Software LLC (“Fulcrum,” “we,” “us”) collects, uses, and shares information in connection with the Fulcrum service and websites, including smbfulcrum.com (the “Service”). By using the Service, you agree to this Policy.
1. Information We Collect
Information you provide: account and contact details (name, email, company, password), billing information (processed by our payment processor), support communications, and any Customer Data you submit to the Service.
Information collected automatically: device and usage data such as IP address, browser type, pages viewed, and interactions, collected through cookies and similar technologies. Information from third parties: for example, our payment processor or authentication providers.
2. How We Use Information
We use information to provide, maintain, secure, and improve the Service; process payments; communicate with you (including service and, where permitted, marketing messages); provide support; comply with law; and protect our rights and users.
3. How We Share Information
We share information with: service providers and subprocessors that help us operate the Service (for example, cloud hosting and payment processing) under confidentiality obligations; authorities or others when required by law or to protect rights and safety; and, in a merger, acquisition, or sale of assets, the successor entity. We do not sell your personal information.
4. Cookies
We use cookies and similar technologies to keep you signed in, remember preferences, and analyze usage. You can control cookies through your browser settings; disabling some cookies may affect functionality.
5. Data Retention
We retain information for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Customer Data is deleted or returned as described in our Terms of Service after account termination.

We use reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your Rights and Choices
Depending on your location, you may have rights to access, correct, delete, or port your personal information, or to object to or restrict certain processing. Residents of certain U.S. states and the EU/UK may have additional rights. To exercise rights, contact us at privacy@smbfulcrum.com; we will respond as required by applicable law. You may opt out of marketing emails using the unsubscribe link.
8. International Users
The Service is operated in the United States. If you access it from outside the U.S., you understand your information may be processed in the U.S. We will provide appropriate safeguards where required by law.
9. Children’s Privacy
The Service is intended for businesses and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child provided information, contact us and we will delete it.
10. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new effective date and, for material changes, provide additional notice.
11. AI, Machine Learning, and Training Data
We do not currently use Customer Data to train artificial intelligence or machine learning models. The Service includes features that let you label and correct the information extracted from your documents; that labeled Customer Data may be used to train and improve the models that power the Service in the future.
You may opt out at any time by emailing privacy@smbfulcrum.com. If you opt out, your Customer Data — including any labels you have applied — is excluded from model training. Opting out does not affect your access to or use of the Service.
